The provider of the site https://mail.fr and the e-mail services contained therein is mail.de GmbH, Friedrich-Ebert-Straße 70, 33330 Gütersloh, Germany. You can find further information regarding our company in our imprint. Please find information below about the collection, processing and use of your personal data by our site and online services in accordance with the regulations of the General Data Protection Regulation (GDPR/DSGVO).

1. Collection, processing and use of your data
1.1 Registration

We collect and use your personal data insofar as they are necessary for the establishment, content-related design or change to a contractual relationship between you as user and us as provider (Section 6(1b) GDPR).

You can register with our e-mail service without entering any personal data.

Insofar as you decide to use additional services which are liable to payment (e.g. registration for the premium package "PlusMail" or additional services, such as SMS etc.), your name or the name of the paying person will be collected in our systems, however not stored, depending on the selected modes of payment. A comparison between the e-mail inbox and payment is carried out through a payment code generated at random, which is deleted with the payment compensation. Your registration/payment will remain anonymous.

All data, which you enter for the registration will be collected through electronic order forms and transmitted encrypted during the order process.

1.2 Traffic data

Traffic data are collected, processed and used in order to enable and settle the use of these services. As a rule date, time as well as time zone of the start and end of the use, the path of the request (the actual webpage), the response status / http-status code and the IP address are recorded. Furthermore, we record the website from which the request originates, the browser and operating system and its user interface as well as the language and version of the browser software. This data will be deleted after fourteen days. The recording of this data is a technical requirement to render the web-page and to ensure the stability and security of our service (Section 6(1f) GDPR).

1.3 Transmission of your data to service providers

Your data will be transmitted to

  • service providers commissioned by us (order data processors), with which corresponding agreements exist according to Section 28 GDPR.
  • service providers for the purpose of determining the remuneration, for settlement and for collection of the remuneration.
  • to criminal prosecution authorities and courts for the purpose of criminal prosecution within the framework of the applicable statutory regulations.
2. Use of your data for advertising purposes (only FreeMail customers)
2.1 Sending of the "mail.fr recommends newsletter"

A registration for our FreeMail offer is only possible if you agree to the use of your data for advertising purposes with the registration. Your data will only be used in order to send you advertising information by mail newsletter. You will then regularly receive our "mail.fr recommends …" newsletter from us.

This newsletter is part of the free FreeMail package. An unsubscription is not possible. In case of a change into our premium package "PlusMail" you will no longer receive the mail.fr-newsletter as well as partner newsletters in future.

3. Storage and deletion of your data | right to information | data protection officer
3.1 Storage

Your data will be stored for the duration of the contractual relationship (Section 6(1b) GDPR). After termination your data will be stored according to the statutory storage deadlines and blocked for all other use. Your data will be deleted after expiry of the statutory deadlines.

3.2 Right to information, correction and deletion or blockage

According to Section 15 et seq. GDPR you are entitled to information about the data, which we store relating to you, free of charge. You are also entitled to have this data corrected, deleted or limited in its use. Furthermore you are entitled to the transfer of this data and the objection to the use of your personal data. 4. Use of cookies and webtracking services (only FreeMail customers)
4.1 Cookies

We use cookies in order to make the visit to our website attractive and to enable the use of certain functions. Cookies are small text files, which are filed on your computer. The majority of the cookies used by us will be deleted by your hard drive again after the end of the browser session (so-called session cookies). Other cookies remain on your computer and enable us to recognise your computer again on your next visit (so-called permanent cookies). You can configure your browser-settings according to your preferences and e.g. disable the use of third-party-cookies. We do inform you that this may prohibit some functionality with our services.
The cookies we use do not contain any personal data. For reasons of transparency, we publish a current list of the cookies we use, their applications and the duration of their storage under https://mail.fr/en/cookies/.

4.2 Utiq

Our use of the Utiq technology

The Utiq technology is provided by Utiq SA/NV, a European company. The technology is designed with privacy in mind to give you choice and control, whilst facilitating responsible digital marketing by websites like us.

Utiq works together with participating telecom operators (see list here) that help power the technology.

The Utiq technology can only be activated and used if you use an internet connection that is supported by Utiq* and provided by one of the participating telecom operators listed below, across the countries where the Utiq technology is available.

* About supported internet connections: in some countries where we operate, the Utiq technology is available only if a mobile connection is used, while in others, it also extends to broadband (i.e., Wi-Fi) connections.

You can find here the list of the internet connections that are supported, per country and per telecom operator.

The Utiq technology is off by default. It can only be activated if you give consent whilst using a supported internet connection provided by one of the participating telecom operators.

If you consent to activate its use, Utiq provides us, mail.de GmbH and our advertising marketer Ströer (the Joint Data Controllers) with marketing identifiers. They help us to understand your browsing behaviour and connect visits across our website(s) and the sites of other companies also working with Ströer (only if you agree to the activation of the Utiq technology on each one separately). We use them for activities like personalising ads or content and analytics on this and other websites using the Utiq technology, depending on the consents you gave within the respective CMP on this website. These identifiers are also shared with partner advertising platforms, listed within the respective CMP on this website where needed to conduct the specific marketing or analytics activities.

If you activate the Utiq technology in any of our websites and the other websites of companies also working with Ströer (see list here) we will be able to use the Utiq technology to collect insights about your browsing activity across such websites (if you give your consent to activate the Utiq technology in each of those websites).

The Utiq technology is linked to the internet connection. This means that anyone using the same connection on their device and consenting to the Utiq technology will receive the same identifier. Typically:

  • on a broadband connection (e.g., Wi-Fi), the marketing or analytics will be performed based on the browsing activities of consenting household members.
  • on mobile data, the marketing will be more personalised, as it will be based on the browsing of the individual mobile user only.

We, mail.de GmbH and our advertising marketer Ströer act as joint controllers together with Utiq for certain stages of the processing. As part of our joint controller arrangement:

  • We collect your consent in relation to the Utiq technology, including for the processing that Utiq and your telecom operator undertake.
  • We provide you with access to a dedicated link at the end of our website ("Manage Utiq") to provide you with information about the technology and how to manage it.
  • Utiq provides you with a privacy portal ("consenthub") to facilitate the exercise of your data protection rights and enable you to easily manage Utiq consents. At any time. In one place.
  • Though you may exercise your rights in respect of any of the controllers, Utiq acts as the common contact point for any questions or requests you may have in relation to the Utiq technology.

You can withdraw Utiq consents* in the following ways:

  • On consenthub: where you can withdraw Utiq consents given across all websites using the Utiq technology, by accessing the Utiq privacy portal ("consenthub").
  • On participating websites: where you can withdraw Utiq consent individually on each website where you gave it, by visiting the "Manage Utiq" page accessible at the bottom of each individual website.

The Utiq technology operates on your internet connection. Therefore, if you use a different connection, you will need to manage your consents for each connection separately.

Alternatively, you can always clean your history and website data via your browser settings. This will delete all Utiq consents from your browser. All the data in the Utiq platform will also be deleted within the timeframes specified in Utiq’s Privacy Statement.

5. CAPTCHA-Services
5.1 Google reCAPTCHA

As protection against abuse we use the reCAPTCHA service of the company Google Inc. with an anonymous registration (Section 6(1f) GDPR). The query serves to distinguish whether the input is carried out by a person or as improper use by automatic, mechanical processing. The query includes the despatch of your IP address and, if applicable, further data required by Google for the reCAPTCHA service to Google as well as an examination of the mouse movement in the field of the checkbox. The deviating data protection provisions of the Google apply to these data http://www.google.de/intl/de/privacy.

If you prevent the storage of cookies or the forwarding of information by browser settings or with add-ons Google will continue to output the classical Captchas. You can also avoid the use of your data by the Google Service reCAPTCHA if you register under your name.

5.2 hCaptcha

As protection against abuse we use the hCaptcha service provided by the company Intuition Machines, Inc. (Section 6(1f) GDPR) their Privacy Policy and Terms of Service apply.

5.3 Friendly Captcha

To make automated access by programs or scripts more difficult and thus increase the security of our services, we use the anti-bot solution provided by Friendly Captcha GmbH, Am Anger 3–5, 82237 Wörthsee, Germany ("Friendly Captcha").

For this purpose, a special program code is integrated, for example in registration and contact forms. When used, a connection to the servers of Friendly Captcha is established, whereupon the user’s end device receives a small computational task. After the calculation, the result is transmitted to Friendly Captcha in order to verify the correctness of the solution. Depending on the result, requests may be processed accordingly or rejected in order to prevent misuse.

The data processed in this context is used exclusively to protect against spam and automated access. No cookies are stored on or read from the users’ devices. The IP address is stored only in hashed form, so that neither we nor Friendly Captcha can draw conclusions about individual persons.

If personal data is processed in the course of this procedure, it will be deleted no later than after 30 days.

The storage of information on the end user’s device or access to information is carried out in accordance with Section 25(2) TDDDG. Data processing is based on our legitimate interest in securing our services against abusive access and attacks pursuant to Art. 6(1)(f) GDPR.
